BleacherPro LLC (“BleacherPro”) will install bleachers provided by Customer. The bleachers will be installed pursuant to the scope of work, assembly drawings, or instructions provided by Customer.
Consent to Subtracting - Customer acknowledges that BleacherPro will hire one or more installers to carry out the bleacher installation, and Customer consents to BleacherPro use of subcontractors.
Customer shall provide the bleachers to be installed and accurate drawings, instructions, and/or specifications. Customer shall prepare the site, including all necessary groundwork, where the bleacher is to be assembled. BleacherPro shall not be responsible for any delay caused by Customer’s failure to meet the requirements of this paragraph.
Furthermore, if the drawings, instructions, and/or specifications provided by Customer for the preparation of BleacherPro’s bid are materially different from the drawings, instructions, and/or specifications needed to actually complete the installation, BleacherPro has the option to cancel this Agreement, or to agree to perform only if the parties can agree to a new price.
In the event that BleacherPro elects to cancel the agreement pursuant to this paragraph, BleacherPro shall be entitled to retain the 10% down payment paid by Customer.
